Dan Gus represents primarily business and corporate clients in a variety of industries in connection with their dispute resolution needs. Mr. Gus has litigated cases in state and federal courts and before arbitration panels. In addition to his trial work, Mr. Gus has handled appeals before Texas courts of appeals, the Supreme Court of Texas and the United States Court of Appeals for the Fifth Circuit. Some of Mr. Gus's representative cases include the following:
- Representation of electric utility company in dispute regarding construction of cogeneration power projects for private hospital system
- Representation of accounting firm in securities litigation
- Representation of individual challenging the National Cutting Horse Association's efforts to prevent the disclosure of its financial records to the National Cutting Horse Association membership
- Representation of municipality that is a member of a joint powers agency in dispute regarding another member municipality's efforts to stop the agency's issuance of hundreds of millions of dollars in bonds to fund new projects and refinance existing debt
- Representation of self-storage company to recover damages due to flooding of one of its facilities due to negligent inspection and maintenance of required erosion control measures on adjacent construction site
- Representation of landowner in dispute with national media company regarding termination of real estate license for operation of broadcast antenna array on large tract of land targeted for development and natural gas exploration in one of Dallas County's largest multi-party real estate transactions in 2008.
- Representation of electric power wholesaler in dispute to recover millions of dollars in damages for failure of three wind farms to produce and deliver the required amounts of renewable energy and renewable energy credits under the parties' power purchase agreements. Following a two-week trial, the jury rendered a multi-million verdict for the power wholesaler and rejected the wind farms' counterclaims.
In addition to his commercial litigation practice, Mr. Gus has substantial experience in litigating commercial insurance coverage disputes, providing coverage advice, and serving as monitoring counsel for excess insurance carriers or carriers providing defenses subject to reservations of rights. As a former in-house counsel for a private investment firm, Mr. Gus is particularly sensitive to the need for cost-effective litigation management that is consistent with the client's overall business objectives.
